WHAT IS BAIL?

In criminal cases, it’s usually a sum of money, set by a court or the jail to obtain your release.  A bail bond needs to be posted by or on behalf of a defendant to guarantee their appearance in court. The right to reasonable bail is guaranteed to you by the Eighth Amendment of the Constitution of the United States.[/su_box]

HOW DOES BAIL WORK?

[su_box title=”Answer” radius=”5″]The court sets an amount of bail required for each charge to obtain release for the defendant. Under state statute, a state licensed bail bond company, “the surety” provides a “bail bond” that guarantees payment of the full bail amount to the court if the defendant fails to show up for all scheduled appearances. For their service of providing the bond, bail bond agent charges a fee or premium. In Florida the state regulates the fee at no less and no more than ten percent for all state bail bonds. Once the defendant is released from jail, the bail premium is not refundable.[/su_box]

HOW LONG DOES IT TAKE TO GET RELEASED FROM JAIL ON BOND?

WHAT HAPPENS IF THE DEFENDANT FAILS TO APPEAR?

[su_box title=”Answer” radius=”5″]If a defendant fails to appear before the court, he may be considered a fugitive and a warrant isnormally issued for their arrest, additionally the court may declare a forfeiture the bail bond. If you think the defendant is going to fail to appear as required, contact Polakoff as soon as possible to review what options are available to you. The bail bond agent makes every effort to locate the fugitive and return them to custody. However, if the bail bond agent is unable to locate the fugitive the bail agent must pay the entire bond amount to the court. The bail bond agent can recover the cost by enforcing the indemnity agreement to reimburse the loss.[/su_box]

WHAT IS FORFEITURE?

The judge then finds the defendant has breached his conditions of bond, declares the bond forfeited and usually issues a warrant for the defendant’s arrest.
